Agreement to Terms: Your use of ProtoForge Academy constitutes acceptance of these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use of our platform and services.

Age Requirements: You must be at least 16 years of age to use our services independently. Users between 16 and 18 years old must have parental or guardian consent. Users under 16 may only access our platform under direct supervision of a parent, guardian, or authorized educational institution.

Account Authority: If you are accessing our services on behalf of an organization, educational institution, or company, you represent and warrant that you have the authority to bind that entity to these Terms and that the entity agrees to be responsible for your actions.

Geographic Restrictions: Our services are provided from Kazakhstan and intended for users worldwide. You are responsible for ensuring that your use of our platform complies with applicable laws in your jurisdiction, including export control and technology transfer regulations related to CNC programming and manufacturing technologies.

To access certain features of ProtoForge Academy, you must create and maintain an account:

Account Creation: You must provide accurate, current, and complete information during registration. You agree to update your information promptly if it changes. Providing false or misleading information may result in account termination.

Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You must immediately notify us at [email protected] of any unauthorized access, security breaches, or suspected misuse of your account. You are liable for all activities that occur under your account.

Account Restrictions: Each individual may maintain only one account. Creating multiple accounts without authorization, sharing accounts, or allowing others to use your credentials is strictly prohibited and may result in immediate termination of all associated accounts.

Account Suspension: We reserve the right to suspend or terminate your account at any time for violations of these Terms, suspicious activity, non-payment, or at our sole discretion. Upon termination, your access to courses, materials, and certificates will be revoked, and no refunds will be provided except as required by law.

All content, materials, and intellectual property on ProtoForge Academy are protected by copyright, trademark, and other laws:

Our Content: All course materials, videos, tutorials, software, 3D models, CAD files, CNC programs, documentation, graphics, designs, logos, and text on our platform are owned by or licensed to ProtoForge Academy. They are protected by international copyright laws and intellectual property rights.

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our educational content solely for your personal, non-commercial learning purposes. This license does not permit you to download, copy, reproduce, distribute, modify, create derivative works, publicly display, sell, or commercially exploit our content without explicit written permission.

User Content: When you submit projects, designs, forum posts, comments, or other content to our platform, you grant ProtoForge Academy a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content for educational, promotional, and operational purposes. You retain ownership of your original work.

Trademark Protection: "ProtoForge Academy" and related logos, marks, and branding are trademarks owned by us. You may not use our trademarks without prior written consent. Any unauthorized use may constitute trademark infringement and violation of applicable laws.

You agree to use ProtoForge Academy responsibly and in compliance with all applicable laws and regulations:

Prohibited Activities: You must not: (a) violate any laws, regulations, or third-party rights; (b) distribute malware, viruses, or harmful code; (c) attempt to gain unauthorized access to our systems or other users' accounts; (d) interfere with platform functionality or security measures; (e) scrape, mine, or extract data using automated tools; (f) impersonate others or misrepresent your identity or affiliation.

Content Standards: You must not upload, post, or transmit content that is: illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, hateful, racially or ethnically offensive, or otherwise objectionable. This includes content that infringes intellectual property rights or contains confidential information without authorization.

Educational Integrity: You must not engage in academic dishonesty, including plagiarism, cheating on assessments, sharing answers, or using our certificates fraudulently. All work submitted must be your own unless collaboration is explicitly permitted in specific courses.

Platform Integrity: You must not reverse engineer, decompile, disassemble, or attempt to derive source code from our platform. You must not remove, alter, or obscure copyright notices, watermarks, or other proprietary markings from our content or materials.

ProtoForge Academy offers various paid courses and subscription plans for advanced 3D modeling and CNC programming education:

Pricing and Payment: All prices are listed in US Dollars (USD) or local currency as indicated. Prices are subject to change without notice, but changes will not affect existing orders or active subscriptions. Payment is due immediately upon enrollment. We accept major credit cards, bank transfers, and other payment methods as specified during checkout.

Subscriptions: Subscription plans automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate. You can cancel your subscription at any time through your account settings, and cancellation will take effect at the end of the current billing period.

Refund Policy: We offer a 14-day money-back guarantee for course purchases. If you are not satisfied with a course, you may request a full refund within 14 days of purchase, provided you have completed less than 25% of the course content. Refund requests must be submitted to [email protected] with your order details. Refunds are processed within 10 business days and returned to your original payment method.

No Refunds: Subscriptions, bundled course packages, and completed courses (>25% progress) are non-refundable. Certificates once issued are also non-refundable. We reserve the right to refuse refund requests that violate our policies or show evidence of abuse.

ProtoForge Academy provides educational services "as is" and "as available" without warranties of any kind:

Service Availability: We do not guarantee that our platform will be available at all times, uninterrupted, secure, or error-free. We may suspend, modify, or discontinue services temporarily or permanently without prior notice for maintenance, updates, or other reasons. We are not liable for any interruptions, delays, or service failures.

Educational Content: While we strive to provide accurate, up-to-date educational content on 3D modeling, CAD/CAM, and CNC technologies, we do not warrant the accuracy, completeness, reliability, or suitability of any information for specific purposes. Technology evolves rapidly, and some content may become outdated. You use our content at your own risk.

Career Outcomes: We make no guarantees regarding employment, career advancement, salary increases, or professional success resulting from completing our courses. Your success depends on many factors outside our control, including market conditions, your skills, effort, and opportunities available in your region.

Limitation of Liability: To the maximum extent permitted by law, ProtoForge Academy, its owners, employees, instructors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or personal injury arising from your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Third-Party Content: We are not responsible for the availability, accuracy, legality, or appropriateness of content on third-party sites. Your interactions with third-party sites are governed by their terms and policies, not ours. We recommend reviewing their terms of service and privacy policies before using external services.

Third-Party Software: Some courses may require or recommend third-party software (e.g., CAD software, 3D modeling tools). You are responsible for obtaining necessary licenses, complying with software terms, and ensuring compatibility with your systems. We are not liable for issues arising from third-party software use.

Payment Processors: We use third-party payment processors to handle transactions. Your payment information is subject to the privacy policies and security measures of these processors. We do not store complete credit card information on our servers.

These Terms are governed by the laws of the Republic of Kazakhstan, and disputes shall be resolved as follows:

Governing Law: These Terms of Use and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law principles.

Jurisdiction: You agree that any legal action or proceeding arising from these Terms or your use of ProtoForge Academy shall be brought exclusively in the competent courts of Almaty, Kazakhstan. You consent to the personal jurisdiction of these courts and waive any objections to venue.

Informal Resolution: Before initiating formal legal proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will work in good faith to reach a mutually acceptable resolution within 30 days.

Arbitration: If informal resolution fails, disputes may be submitted to binding arbitration under the rules of the International Arbitration Court at the Chamber of Commerce and Industry of the Republic of Kazakhstan. Arbitration shall be conducted in Almaty, Kazakhstan, in English or Russian language. The arbitrator's decision shall be final and binding.

ProtoForge Academy reserves the right to modify these Terms and manage our platform as follows:

Terms Modifications: We may update these Terms of Use at any time to reflect changes in our services, legal requirements, or business practices. Material changes will be notified via email or prominent website notice at least 15 days before taking effect. Your continued use of our platform after changes become effective constitutes acceptance of the revised Terms. If you disagree with modifications, you must discontinue use of our services.

Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of our platform, courses, or features at any time with or without notice. We may add or remove courses, change pricing, update content, or alter platform functionality as needed to improve educational quality and user experience.

Termination Rights: We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including breach of these Terms, illegal activities, non-payment, or at our sole discretion. Upon termination, your right to use our services ceases, and you must destroy all downloaded materials. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will remain in effect.
